A Georgia grand jury indicted Kim Zolciak and Kroy Biermann‘s son, Kroy “KJ” Biermann Jr., on seven felony counts on Thursday, Sept. 3.
The Real Housewives of Atlanta alum and retired NFL player’s 15-year-old son is facing charges of aggravated child molestation, aggravated sexual battery, aggravated sodomy, false imprisonment and three counts of sexual battery against a child under the age of 16, according to court records viewed by PEOPLE.
The indictment stems from an incident that allegedly occurred on April 23, 2026.
Kroy Jr. was arrested on Aug. 17 in Alpharetta, Ga., according to court documents previously obtained by PEOPLE. Authorities took him into custody at the Metro Regional Youth Detention Center in Atlanta. He remains in custody and is scheduled to appear in court on Sept. 9.

After Kroy Jr. was arrested, his mother issued a statement, telling Us Weekly, that the allegations are “nothing short of reckless and deeply troubling.”
“The allegations being made against my son are nothing short of reckless and deeply troubling. He categorically denies ever being involved with this woman or engaging in the conduct she has alleged,” Zolciak, 48, said.
“My son voluntarily took a polygraph examination regarding these allegations and passed. Additionally, an examination was conducted, and no DNA belonging to my son was found,” Zolciak said.
“False accusations can have devastating consequences not only for the person being accused, but also for genuine survivors of sexual assault and abuse. Every legitimate allegation deserves to be taken seriously and investigated based on the facts and evidence,” she continued. “At the same time, no one should be publicly condemned based solely on an accusation.”
“We remain confident that the facts and evidence will establish the truth, and we ask that people allow the proper process to take its course rather than spreading unproven allegations,” Zolciak concluded.
Kroy Jr. is one of six children the estranged couple share. The former couple, who are in the middle of a contentious divorce, also share son Kash, 14, and twins Kaia and Kane, 12. Biermann, 40, also adopted Zolciak’s daughters Ariana, 24, and Brielle, 29, from a previous relationship.
In April 2023, after roughly 12 years of marriage, Zolciak and Biermann filed for divorce. However, in July 2023, a source told PEOPLE that the couple called off the divorce and are “trying to make it work for the kids.” Then, in August 2023, Biermann filed for divorce for a second time.

Zolciak filed a motion for an emergency hearing in June, alleging that the former professional football player was not taking proper care of their four children while they were in his custody, according to court documents obtained by PEOPLE. In the filing, Zolciak claimed that without the court’s immediate intervention, the minor children were “at risk of ongoing mental and physical abuse” by her former partner, claiming they “constantly” reach out to her for food or medicine while in his care.
Zolciak also alleged that one of her children was subjected to “frightening rage fueled tirades” from Biermann. She also alleged that at least one of their younger children expressed to their therapist that they’ve experienced “mental, emotional and physical abuse” from him.
The status of Zolciak’s motion is not known.

Zolciak’s claims came after the May ruling, in which a judge granted the former professional football player primary physical custody of their four kids, after he filed an emergency motion and alleged that Zolciak was “unstable and unfit.”
Zolciak and Biermann continue to share joint legal custody of the children. However, Biermann will reportedly have final decision-making authority for education, non-emergency medical, and religious decisions. Both have limited parenting time with the children every other weekend.
