Scott Wolf’s Ex Kelley Wolf Charged with Violating Protective Order for Trying to Contact Son, 12, Through Friend

NEED TO KNOW

  • Scott Wolf’s ex Kelley Wolf was charged with violating a protective order by attempting to contact her son Miller, 13
  • Scott accused Kelley of contacting him by “using a friend’s phone and attempting to contact her son [Miller] through a friend’s son”
  • Kelley is also facing three misdemeanor charges amid her divorce from Scott

Kelley Wolf’s legal troubles are continuing to escalate.

In court documents obtained by PEOPLE, The Real World: New Orleans alum, 48, was charged with a misdemeanor for violating the Aug. 28 protective order which stated she cannot have any direct or indirect contact with Scott Wolf, 57, or the couple’s three children — sons Jackson, 16, and Miller, 12, and daughter Lucy, 11. She was also ordered to remain at least 300 feet away from Scott.

At the time, Kelley was only allowed to have contact with Scott during mediation sessions scheduled with a “Court Qualified Mediator” regarding their divorce or custody.

In a Statement of Probable Cause, Scott accused Kelley of violating the protective order on Aug. 30 by contacting him “using a friend’s phone and attempting to contact her son [Miller] through a friend’s son.”

Also filed was a summons for Kelley to appear in court on Nov. 7.

Kelley last appeared in court on Sept. 10 and was without legal representation, a source told PEOPLE at the time.

Due to the lack of legal counsel present for Kelley, the judge would not rule on any matters, despite Scott’s lawyers’ requests for a full restraining order to be established.

The judge upheld parts of the Aug. 28 protective order, that she cannot have any direct or indirect contact with her kids. But the judge did allow Kelley and Scott to communicate with each other via phone, as the judge said that is what’s best for their kids, per the source. Neither party is required to answer the other’s communication, especially if issues arise.

The next hearing in the divorce will be on Oct. 23, and the judge told Kelley she needs to retain a lawyer before that date. The judge ordered that Scott is responsible for a portion of her attorney fees, according to a source.

In addition to the latest charge, the television personality is facing three misdemeanor charges. The charges include misdemeanor electronic communications harassment and two charges of misdemeanor electronic disclosure of personal identifying information.

Kelley was arrested on Aug. 26 on suspicion of electronic communication harassment and electronic disclosure of personal identifying information, the Summit County Sheriff’s Office told PEOPLE at the time.

The arrest followed days of apparent confrontational social media posts, allegedly doxxing her friends and family members. One post included Scott’s personal phone number with others, including communication with her and Scott’s three children.

Kelley’s social media usage violated the pair’s temporary stipulated agreement granted on Aug. 26, which contained a social media and press gag order for them to not post about each other, their marriage, their children or their divorce.

Kelley was released from Summit County Jail two days later, a public information officer for the Summit County Sheriff’s Office confirmed to PEOPLE.

Per court documents obtained by PEOPLE on Aug. 28, as a condition of her release, the former reality star must not “consume any alcohol or narcotic drug or other controlled substance unless prescribed by a licensed medical practitioner.” She must also “participate in inpatient or outpatient medical, behavior, psychological, or psychiatric treatment.”

Since her release, Kelley entered rehab on Sept. 7 and exited one day later, multiple sources told PEOPLE.

Kelley initially informed a district court judge of her plans to enter a rehabilitation treatment center when appearing in court on Sept. 2. Kelley revealed during her arraignment that she was planning to enter a treatment center on Sept. 12. She said she was “looking forward to it.”

After exiting the treatment facility on Sept. 8, sources told PEOPLE she was staying at a hotel.
