“Baywatch” Alum David Charvet Will Not Face Charges After Hitting Neighbor's Dog in Malibu: Sheriff

"He intends to correct the lies communicated on this incident and protect his reputation and safety," a rep for Charvet told PEOPLE

David Charvet won't face charges after he was accused of hitting a pet dog while driving in Malibu.

On Friday, April 24, a rep for the Baywatch alum, 53, told PEOPLE that no charges have been filed against him after local authorities determined that the incident, which involved a neighbor's dog, was an accident.

"David Charvet has been subjected to significant online harassment that has elevated to the level of death threats. He intends to correct the lies communicated on this incident and protect his reputation and safety," Charvet's rep said. "David also hopes to create awareness around pet safety and the prevention of animal cruelty."

The actor was driving in the early morning of April 16, when his vehicle struck the animal.

"It sounds like it was accidental and that the dogs were off leash and ran into the roadway," the Malibu/Lost Hills Sheriff's Station previously told PEOPLE, adding, "[Charvet] tried to swerve to avoid hitting them."

Charvet's rep claimed on Friday that photo and videos showed that the dog's owner was "violating the law by walking all of her dogs without a leash."

"The video and photographic evidence contradict the false statements that were provided to the police and shared publicly," his rep claimed. "In addition, hours after the accident caused by the dog being off a leash, there is video confirming that the dog’s owner was walking on the street with two of her other dogs, both off leashes."

Although the the Malibu/Lost Hills Sheriff's Department could not comment on whether there was "photographic and video evidence," the office told PEOPLE on April 24 that the "final determination" of the investigation was that it was an accident and no crime was committed.

The dog's owner, Vera Errico, initially told TMZ she was walking her three dogs on leashes around 6 a.m. in a gated community in Malibu.

She claimed the actor drove by in a pickup truck, hit one of the dogs and drove out of the community before he called authorities. The dog, an 11-year-old white English Labrador named Sunday, was then euthanized at the vet, she told TMZ. Errico also said she and her husband filed a report with the L.A. County Sheriff's Office regarding an alleged "hit and run."

An unnamed law enforcement source who spoke to TMZ said authorities do not consider the incident a hit-and-run, because Charvet called police after it happened.

Charvet's rep previously told PEOPLE that he is "is an animal lover and responsible dog owner who would never intentionally harm an animal" and "his thoughts are with the family who lost their dog."

Charvet appeared as Matt Brody in the original Baywatch series from 1992 to 1996. His other notable credits include playing Craig Field on Melrose Place from 1996 to 1998. The actor and father of two eventually stepped away from Hollywood and shifted his focus to construction, launching Jones Builders Group with a partner in 2008 to build luxury homes in the Los Angeles area.
