Tony Romo Allegedly Had Open Bottle of Alcohol in Car During OWI Arrest, Police Say

Romo was arrested on Thursday, July 23 in Wisconsin for allegedly operating a vehicle while intoxicated

Tony Romo was allegedly driving with an open bottle of alcohol when he was arrested on July 23 in Wisconsin.

According to citations from the Milwaukee County Sheriff’s Office obtained and reviewed by PEOPLE on Wednesday, July 29, officers discovered an “open bottle of an alcohol beverage” on the passenger side of the 46-year-old former Cowboys quarterback’s Jeep.

A police officer apparently discovered the bottle while officials were taking inventory of Romo’s car before it was towed, per the citation.

A fine of $267 has been issued to Romo for the possession of “open intoxicants in MV-driver,” the citation said.

The California Post was first to report that Romo allegedly had an open container at the time of his arrest.

Romo was cited for unsafe passing after officers said he drove “in the marked right distress lane to pass vehicles in lane 1 and 2 during rush hour traffic” and “cut across the marked gore” before his arrest. An officer said the former NFL star “was in question on what a gore was when I explained the reason for the stop” in the citation.

According to the citation, Romo’s unsafe passing earned him an additional fine of $235.

A third citation for Romo alleges that he was “operating while under the influence,” according to the documents. That citation adds another fine of $1,066 to Romo’s tab.

Bodycam footage released by NBC 5 DFW and WFAA on July 28 shows Romo interacting with officers after being pulled over. He told police he had been coming from a golf course and visiting grandparents.

When asked how many drinks he’s had, Romo told the officer, “zero.”

Romo participated in a number of standard field sobriety tests during the stop, but footage shows that he told officers he was not willing to take a PBT (preliminary breath test). “Oh no, we’re not doing that. I’ve already heard from all the lawyers, ‘Don’t ever do that.’ ”

Romo is then put in handcuffs again as he says, “Can I call, real quick? [Inaudible] literally waiting there with my son,” in the footage.

A Milwaukee County Sheriff’s Office report detailing the stop said Romo “performed poorly” on the “SFSTs,” or standardized field sobriety tests, per NBC 5 DFW.

Romo is expected to appear in court on Monday, Sept. 21.
